COMPETITION for the best article on legal topics!

JGA Legal and Tax Advisory and the legal portal prawowobrocie.pl invite law students from the Faculty of Law and Administration at the University of Silesia in Katowice to participate in a competition for the best article on legal topics.

Thematic scope of the articles:

  • commercial and economic law,
  • civil law,
  • civil procedure,
  • administrative and public law,
  • tax and financial law.

The total prize pool for the competition is PLN 1,000! Additionally, the winning article will be published on our website www.prawowobrocie.pl.

To participate in the competition, simply follow these steps:

  • Facebook.
  • respond to the pinned competition post’s comment section with an answer to the question: “In which branch of law, from the categories listed on the prawowobrocie.pl portal, would you like to practice in the future and why?” If it is a different field of law than those listed on our website, indicate it in your response and briefly explain your willingness to practice in that particular area.
  • prepare and submit an article on your chosen topic along with your competition entry to the email address: konkurspwo@jga.com.pl

The deadline for submitting competition articles is 15 May 2021.

Information regarding the processing of personal data

  1. Personal data controller

    JGA-Doradztwo Podatkowe sp. z o.o., with its registered office in Katowice, address: ul. Kilińskiego 34 (hereinafter referred to as the “Organizer”), is, in view of the applicable regulations, the data controller of your personal data as a participant in the contest for the best article on legal topics (hereinafter referred to as the “Contest”). This means that we are responsible for their secure utilisation in accordance with the agreement and applicable regulations. For matters related to the protection of your personal data and the exercise of your rights, you can contact us via email: iod@jga.com.pl or in writing to the address of our registered office provided in point 1.

  2. Purposes and legal bases of processing

Your personal data will be processed for the following purposes:

  1. carrying out the Contest and announce its results based on your consent – for the duration of the Contest (legal basis: Article 6(1)(a) of the GDPR), provided that the Participant’s submission to the Contest constitutes a clear affirmative action by the Participant as referred to in Article 4(11) of the GDPR, thereby giving consent to the Organiser to process the Participant’s personal data, such as their first name, last name or pseudonym, within the framework of the Facebook.com platform, information concerning the liking of the prawowobrocie.pl fan page on Facebook, email address, telephone number, and bank account number for the purpose of organising and resolving the Contest;
  2. fulfiling the obligations related to the resolution of the Contest – until the expiration of claims (legal basis: Article 6(1)(b) of the GDPR in conjunction with Article 6(1)(c) of the GDPR);
  3. presenting information about the Contest participants on the legal blog www.prawowobrocie.pl and on social media platforms based on your consent – until you withdraw your consent (legal basis: Article 6(1)(a) of the GDPR);
  4. for purposes related to the management of the prawowobrocie.pl fan page on Facebook (legal basis: Article 6(1)(f) of the GDPR);
  5. fulfiling legal obligations imposed on the Organiser regarding the awarding of prizes (e.g., income tax settlement, issuing certificates of winning, recording awarded prizes)

(I) for the duration of fulfiling legal obligations (legal basis: Article 6(1)(c) of the GDPR);


(II) for the period of time specified by laws requiring the Organiser to retain certain data, such as tax-related data (legal basis: Article 6(1)(c) of the GDPR); or

(III) for the period of time in which the Organiser may face legal consequences for non-compliance with obligations (legal basis: Article 6(1)(f) of the GDPR).

  1. handling complaints or defending against claims – for the period after which claims arising from the Contest become subject to limitation (legal basis: Article 6(1)(f) of the GDPR).

    3. Data recipients

The following categories of entities are recipients of your data:

  1. entities authorised to process data based on legal provisions; (delete as appropriate)
  2. entities processing data on our behalf, participating in the performance of the Organiser’s activities;
  3. other data controllers processing data on their own behalf, to whom the transfer of data is necessary for the performance of a specific task, e.g.

(I) entities engaged in payment services (banks, payment institutions) – for the purpose of awarding the prize to the participant;
(II) in the case of consent to the inclusion of participant’s data in social media posts: entities operating social media platforms located in countries outside the European Union or located in European Union member states, but transmitting data to third countries.

We would like to inform you that participation in the Contest involves the processing of participant’s data on the Facebook platform. Participants can edit or delete their comments and reactions left on our fan page at any time. If a particular participant does not do so, their actions will remain visible for the duration of their availability on the Facebook platform.

Additionally, at any time, a participant can stop following our profile – in such a situation, they will be removed from the list of followers of our fan page. However, please note that the conditions for participating in the Contest include, amongst other things, liking our fan page and answering the contest question. If you agree to the inclusion of your personal data in social media posts, in the event of winning, we will include your data in the information published on our profiles.

In particular, we intend to publish on the prawowobrocie.pl profile available on Facebook. European users of Facebook are serviced by Facebook Ireland Ltd., which is based within the European Union. Nevertheless, Facebook exchanges data globally, so information controlled by Facebook Ireland will be transferred to the United States or other countries outside the European Union by being stored in databases located in third countries. Facebook utilises standard contractual clauses approved by the European Commission and relies on European Commission decisions determining the adequate level of data protection with regard to particular countries, where applicable, regarding the transfer of data from the European Economic Area to the United States and other countries. However, it should be noted that there is a risk that you may not be able to fully enforce your rights and effectively take legal action in the case of infringement on your rights by administrators of social media platforms.

4. Automated decision-making, including profiling

We will not make decisions based on your personal data in an automated manner, including profiling.

5. Data processing period

Your data will be processed for the duration of the Competition until its resolution, and thereafter for the period of the limitation of claims. As a rule, the Organiser has no control over the retention period of the participant’s personal data processed on the Facebook platform. The participant’s personal data on Facebook is processed in accordance with the regulations and privacy policy of Facebook. The Organiser is unable to delete the participant’s data from Facebook – only the participant can do so.

6. Your rights

Since we will be processing your personal data, you have rights that enable you to submit requests to us regarding:

  1. rectification of your data (delete as appropriate)
  2. erasure of your data;
  3. restriction of the processing of your data;
  4. access to your data;
  5. data portability to another data controller to the extent specified in Article 20 of the GDPR;
  6. the right to object to the processing of data in accordance with Article 21 of the GDPR.

You can submit your requests by mail to our address or by email to iod@jga.com.pl. To ensure that you are a person entitled to submit the request, we may ask you to provide additional information to confirm your identity. The scope of each of these rights and the situations in which they can be exercised are determined by applicable law. The particular right you can exercise will depend, for example, on the legal basis for our use of your data and the purpose of its processing.

7. Complaint

You have the right to lodge a complaint with the President of the Personal Data Protection Office if you believe that your personal data is being processed by us in contravention of applicable data protection laws.

8. Information on the requirement/voluntariness of providing data

Providing your data is voluntary, but necessary in order to participate in the Competition. In the event of winning a prize, failure to provide a bank account number will prevent the transfer of the monetary prize. You have the right to withdraw your consent to the processing of personal data that you have previously given. The withdrawal of consent does not affect our right to process the data until the consent is withdrawn.
