INFORMATION CLAUSE ON THE PROCESSING OF PERSONAL DATA The Controller of personal data of individuals using the website jga.com.pl (hereinafter referred to as “JGA website”) – hereinafter referred to as “Users” or each individual “User” – is:

  • JGA Ginckaj, Morawiec, Olszewski, Stankiewicz Law Firm, a limited liability partnership with its registered office in Katowice (40-062), address: ul. Jana Kilińskiego 34, entered in the National Court Register maintained by the District Court Katowice-Wschód in Katowice, 8th Commercial Division of the National Court Register under the KRS number 0000209897, tax identification number (NIP) 6342378087, statistical number (REGON) 276749379, or;
  • JGA Tax Advisory Wiśniewski, Sablik and Partners limited joint-stock partnership, with its registered office in Katowice (40-062), address: ul. Jana Kilińskiego 30, entered in the National Court Register maintained by the District Court Katowice-Wschód in Katowice, 8th Commercial Division of the National Court Register under the KRS number 0000968987, tax identification number (NIP) 9542581742, statistical number (REGON) 240581360, with share capital of PLN 50,700.00 (fully paid);and in the scope of the subpage legaltech.jga.com.pl:
  • JGA IT Solutions Sp. z o.o. with its registered office in Katowice (40-062), address: ul. Jana Kilińskiego 30, entered in the register of entrepreneurs of the National Court Register maintained by the Katowice-Wschód District Court in Katowice, 8th Commercial Division of the National Court Register under the KRS number 0000911074, tax identification number (NIP) 6342999211, statistical number (REGON) 389451882, with share capital of PLN 5,000.00 (fully paid);

– each of these companies hereinafter jointly referred to as “Administrators”, and individually as “JGA Law Firm,” “JGA Tax Advisory,” or “JGA IT Solutions.”

Users can contact the Controllers by:

 

Users’ personal data will be processed for the following purposes:

  • in the case of JGA Tax Advisory:
  • conclusion and performance of contracts for the provision of newsletter services through the JGA website, based on Article 6(1)(b) of the European Parliament and Council Regulation (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data, the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) – hereinafter referred to as “GDPR”;
  • fulfilling legal obligations incumbent on JGA Tax Advisory in connection with concluded contracts for the provision of newsletter services, based on Article 6(1)(c) of the GDPR;
  • pursuing claims and defending against claims related to concluded contracts for newsletter services, based on the legitimate interest of JGA Tax Advisory under Article 6(1)(f) of the GDPR;
  • conducting marketing and promotion of services provided by JGA Tax Advisory, based on the legitimate interest of JGA Tax Advisory under Article 6(1)(f) of the GDPR;
  • contacting the User, based on the legitimate interest of JGA Tax Advisory under Article 6(1)(f) of the GDPR;
  • conducting statistics regarding the JGA website, based on Article 6(1)(a) and Article 6(1)(f) of the GDPR.
  • in the case of JGA Law Firm:
  • informing about the provision of services by JGA Law Firm, based on the legitimate interest of JGA Law Firm under Article 6(1)(f) of the GDPR;
  • contacting the User, based on the legitimate interest of JGA Law Firm under Article 6(1)(f) of the GDPR;
  • conducting statistics regarding the JGA website, based on Article 6(1)(a) and Article 6(1)(f) of the GDPR;
  • in the case of JGA IT Solutions:
  • conducting marketing and promotion of services provided by JGA IT Solutions, based on the legitimate interest of JGA IT Solutions under Article 6(1)(f) of the GDPR;
  • contacting the User, based on the legitimate interest of JGA IT Solutions under Article 6(1)(f) of the GDPR;
  • conducting statistics regarding the legaltech.jga.com.pl subpage, based on Article 6(1)(a) and Article 6(1)(f) of the GDPR.
  • The Controller of Users’ personal data processed for specific purposes set forth in paragraph 3 of the information clause is JGA Law Firm, JGA Tax Advisory, and JGA IT Solutions. In the case of entering into and performing contracts for the provision of a newsletter service, as well as pursuing claims and defending against claims or fulfilling legal obligations, JGA Tax Advisory is the data controller for Users’ personal data in this regard.

 

JGA Law Firm, JGA Tax Advisory, and JGA IT Solutions jointly process Users’ personal data for marketing purposes and informing about their services.   However, when a User contacts an employee, collaborator, partner, or shareholder of any of the Controllers, the data controller for the User’s personal data in that respect will be the respective company in which the employee, collaborator, partner, or shareholder works or operates, with whom the User has contacted.   Furthermore, Users’ data collected by cookies on the JGA website is jointly processed by the Controllers, as stated in the cookies policy of this privacy policy.

  • Providing Users’ personal data to the Controllers is voluntary. However, providing the aforementioned data by the User is necessary to achieve the purposes specified in paragraph 3 of the information clause.Regarding Users’ personal data processed on the basis of the legitimate interests of the Controllers, Users may at any time object to this type of personal data processing in accordance with the provisions of the GDPR (by contacting in the manner referred to in paragraph 2 of the information clause). In the case of personal data processed based on expressed consent, Users may withdraw their consent to the processing of their personal data in this regard at any time. However, withdrawing consent does not affect the lawfulness of the processing that was carried out based on the consent, prior to its withdrawal.• The Controller may disclose Users’ personal data to entities cooperating with the Controller in order to improve customer service quality. These entities will strive to protect the received data in accordance with the Controller’s privacy policy. Subject to the above, the Controller does not disclose any data provided by Users to third parties unless the Controller is required to do so by a directive of a public authority such as a court or prosecutor’s office, issued based on generally applicable laws and regulations.Personal data provided by Users in connection with using the JGA website or directly sent to the Controllers via email is not subject to commercial transactions.

 

The Controllers indicate that Users’ personal data provided in connection with the conclusion and performance of newsletter service agreements, as well as data collected through cookies, may be transferred to third countries, i.e., outside the EEA (European Economic Area), and stored there in accordance with the applicable data protection laws. For example, in the course of performing newsletter service agreements, Users’ personal data may be collected and stored by the entity operating the MailChimp platform, namely Intuit Inc., 2700 Coast Avenue Mountain View, CA 94043 United States – transferred to Intuit Inc.’s server located in the United States and stored there. Intuit Inc. is a party that exercises due diligence to comply with the standards of the European Union regarding the protection of personal data. At the same time, we note that the collaboration with Intuit Inc. is based on standard contractual clauses in accordance with Article 46 of the GDPR.

  • Users’ personal data is not subject to automated decision-making, including profiling.
  • Users’ personal data will be processed for the time necessary for the purposes for which they are collected (as specified in paragraph 3 of the information clause):
  • in the case of personal data processed for the purpose of concluding and performing newsletter service agreements, for the term of the concluded agreement;
  • in the case of personal data collected for the purpose of pursuing claims and defending against claims, until these claims are subject to the statute of limitation;
  • in the case of fulfilling legal obligations, until the time they have been fulfilled and until all claims related thereto have been barred by limitation;
  • in the case of conducting marketing and promotion of services, until the User raises objections in this regard or until the time the business purpose ceases;
  • in the case of processing personal data for the purpose of contacting the User, for the time necessary to address the issues the User contacts the Controllers about, and for securing potential claims (until they are barred by limitation under applicable law) or until the time the User raises objections in this regard.

 

Users have the right to:

  • access their personal data;
  • delete or rectify their personal data;
  • object to the processing of their personal data;
  • withdraw consent for the processing of their personal data;
  • restrict the scope of the processing of their personal data.

The implementation of these rights must not adversely affect the rights and freedoms of others (including intellectual property rights or trade secrets). The scope of each of these rights and the situations in which they can be exercised are determined by the provisions of the law. The extent to which a User can exercise these rights may depend, for instance, on the legal basis for the use of Users’ personal data by Data Controllers and the purpose of the processing thereof. In order to exercise the aforementioned rights, the User may contact the Data Controllers in the manner indicated in paragraph 2 of the information clause. The User has the right to lodge a complaint with the President of the Personal Data Protection Office (PUODO) if they believe that the processing of their personal data contravenes the provisions of applicable law. The JGA website does not automatically collect information from Users, except for information contained in so-called cookies.

Cookies are computer data (in particular, small text files) sent to the end device of the JGA website User. Cookies are placed on the end device of the JGA website User by the Controllers. Cookies generally consist of a unique number, a specified storage time on the User’s end device, and data individualising the domain associated with the cookies.

The JGA website cookies collect and store information about Users for the following purposes:

  • analysing and creating statistics that help understand how Users use the JGA website, which allows for improvement and development of the JGA website;
  • measuring traffic on the JGA website, which enables customisation of the JGA website content to Users’ preferences and optimisation of the use of the JGA website;
  • ensuring the functionality of the JGA website by enabling the website to remember the settings concerning JGA website, chosen by the User. • ensuring the reliability of the JGA website’s operation. The following types of cookies are used on the JGA website:
  • persistent cookies: these are cookies that are stored on the User’s end device for a specified period, as set in the cookie settings (the parameters of these cookies can be checked by the User through internet browsers; the information on their handling is included in paragraph 8 of the cookie policy), or until they are deleted by the User;
  • session cookies: these are cookies that are stored on the User’s end device until they leave the JGA website by visiting another page, logging out, or closing the browser by the User;
  • third-party cookies: these are cookies that originate from service providers collaborating with the Controllers. This type of cookies allows, amongst other things, measuring and analysing traffic on the JGA website, obtaining information on how the users use the JGA website, and customising the content of the JGA website according to user preferences. Settings can be changed in the banner that appears on the website. By categorising the cookies used on the JGA website in a different manner from the one presented in paragraph 4 of the cookie policy, we can divide them into:
  • necessary cookies: essential for the proper functioning of the JGA website, enabling the use of the services available on the JGA website.
  • functional cookies: allowing Users to save selected settings of the JGA website;
  • analytical cookies: allowing the collection of information on how Users interact with the JGA website, thereby enabling customisation of the JGA website to Users’ needs and preferences, as well as improving the functionality of the JGA website. The JGA website uses the following cookies:
  • _gid – an identifier assigned to the service (assigns cookies for the website), refreshed every 24 hours, operates in the background with the User’s consent, and updates again after 30 days
  • _ga – a cookie responsible for saving visitors’ data, operates based on consent, active for 2 years
  • _gtm – saving visitors’ data, refreshed every 8 hours, operates in the background with the User’s consent, and updates again after 30 days • _lang – a cookie responsible for remembering the language version of the website, deleted after 9 months

The Controllers are not responsible for the data processing rules of websites to which the links posted on the JGA website lead. In this regard, the Controllers recommend reviewing the privacy policies contained on the websites visited by the User after clicking on a link posted on the JGA website.

The Controllers emphasise that disabling or limiting the use of certain cookies may affect some functionalities of the JGA website.

The condition for the operation of cookies is their acceptance through the form that appears on the JGA website and refraining from deleting such cookies from the end User’s device memory. The User can change cookie settings at any time, configure their handling, thereby blocking cookies. Detailed instructions on changing settings, options, and handling of cookies have been set forth in paragraph 7 of the cookie policy. The User can change their internet browser settings regarding the automatic handling of cookies at any time.

When using the JGA website through a mobile device such as a smartphone or tablet, the JGA website uses cookies in a similar way as when accessed through a desktop computer.

The JGA website utilises Google Analytics tools, i.e. those of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States. Google Analytics tools are used for generating statistics, analysing them, and optimising websites. Information collected and stored, concerning Users’ usage of the JGA website, may be transferred to and stored on Google LLC’s servers located in the USA. Google LLC ensures compliance with European Union data protection standards. We wish to emphasise, that the cooperation with Google LLC is based on standard contractual clauses in accordance with Article 46 of the General Data Protection Regulation (GDPR).
