JGA acts as the legal representative of two debtors in bankruptcy proceedings

The JGA team advised and represented two debtors in bankruptcy proceedings. The first debtor was a company providing, amongst other things, tire exchange services. The second debtor was a partnership engaged in the sale of dietary supplements and nutrition products. For both entities, the common factor leading to insolvency was the outbreak of the COVID-19 pandemic and the gradually imposed restrictions. Although special provisions suspended the deadline for debtors to file for bankruptcy, after analysing the legal and economic situation, the decision was made to file for bankruptcy as both entities had no prospects of saving their businesses.

Following the filing of the applications, temporary court-appointed supervisors were appointed in both cases. In both the first and second case, the temporary supervisor prepared a report confirming the reasonableness of the submitted applications. Consequently, the District Court in Gliwice and the District Court Katowice-Wschód in Katowice declared the bankruptcy of the entities.
